Agreement to Terms

By using the Victorious Moments Photography website and services, you agree to the Terms & Conditions outlined here. If these terms do not align with your expectations, we kindly encourage you not to proceed with booking.


1. Booking & Confirmation

A session is only confirmed once both the contract is signed and the required deposit is received. Inquiries or consultations do not secure a booking.

Bookings can be made up to three (3) months in advance through the online calendar, subject to availability.


2. Payment
  • A non-refundable deposit is required to secure your session
  • The remaining balance must be paid prior to or on the day of the session
  • Additional images and services will be invoiced separately


3. Session Policies

Punctuality

  • Clients are expected to arrive on time. Late arrivals will result in reduced session time. Extensions are not guaranteed.

Guests

  • Clients may bring one support person unless otherwise agreed. For family sessions, only participants being photographed should attend

Children

  • Parents/guardians are responsible for supervising children at all times during the session.

Outfit Changes

  • 30-minute sessions and mini sessions include one outfit only
  • Multiple outfits require booking a longer session
  • For outdoor sessions, clients are responsible for planning and managing their outfit changes. Access to a private or public changing space is not guaranteed. Clients are encouraged to plan accordingly or choose outfits that can be easily adjusted by adding or removing pieces.
  • Time allocated for outfit changes is included within the session duration. Clients must inform the photographer at the start of the session of the number of outfits they plan to wear so that time can be managed accordingly. If no prior indication is given, the session will be assumed to be a single-outfit session and will proceed without pauses for outfit changes.

Readiness & Timing

  • Clients are expected to arrive fully prepared and ready to begin shooting at their scheduled session start time. Hair, makeup, and styling should be completed prior to arrival.
  • If clients plan to change outfits on-site, they must arrive early enough to do so and still be ready to begin shooting at the scheduled start time. Any time spent getting ready, changing, or completing hair/makeup during the booking will be deducted from the total session time. Session end times will not be extended due to late readiness.
  • Makeup artists, hairstylists, or additional beauty/styling personnel are not permitted at the session unless previously authorized by the photographer in writing. Only minor touch-ups during the session are permitted.



4. Location, Travel & Studio
  • Outdoor and in-home sessions are available. A travel fee applies for locations beyond 20 km from downtown Ottawa.
  • For locations outside of Ottawa, an additional travel fee will apply based on distance. This is typically calculated at a flat rate (e.g., $25 for nearby extended distances), but may vary depending on the location. The exact fee will be confirmed at the time of booking.
  • Studio rental fees (if applicable) are the responsibility of the client and include in the invoice sent by the photographer, unless otherwise stated.
  • The photographer is not responsible for limitations related to location conditions, including crowds, lighting, access restrictions, or environmental factors.


5. In-Home Sessions & Preparation
  • Clients are responsible for preparing the space prior to the photographer’s arrival. The area should be clean, tidy, and free of any objects that may interfere with the session.
  • For optimal results, it is recommended to select a space near a window or in a room with ample natural light, as this aligns with the bright and natural style reflected in the photographer’s work.
  • Backgrounds cannot always be fully corrected in editing. Clients are encouraged to ensure that all visible areas within the frame are clean and visually organized.


6. Event Photography & Venue Permissions
  • Clients are responsible for confirming that photography is permitted at the selected venue and for obtaining any required permissions.
  • This also applies to events not organized by the client (e.g., graduations, convocations, or third-party events). Victorious Moments Photography is not responsible for any restrictions that may limit or prevent photography coverage.


7. Scent-Free Environment
  • Clients are encouraged to avoid wearing strong perfumes, colognes, or body sprays during their session.
  • This is especially important for outdoor sessions, as strong scents may attract insects and impact the experience. Please also note that the photographer has a sensitivity to strong fragrances.


8. Image Selection & Delivery

A proof gallery will be provided for image selection. Editing begins once selections are submitted.

Estimated turnaround times:

  • Portrait sessions: 10–15 business days
  • Events: 3–4 weeks

Rush delivery may be available for an additional fee.


9. Image Quantity & Additional Edits
  • Each package includes a set number of edited images. Additional images may be purchased at a rate of $5 per image.
  • Requests for advanced retouching beyond standard editing may incur additional fees.


10. Editing Style

By booking, clients acknowledge and accept the photographer’s editing style. RAW (unedited) images are not provided.


11. Cancellations & Rescheduling
  • Deposits are non-refundable. Rescheduling requests must be made with reasonable notice and are subject to availability.
  • If the photographer must reschedule due to unforeseen circumstances, a new date will be offered.


12. Weather Policy
  • Outdoor sessions may be rescheduled in the event of unfavorable weather conditions (e.g., rain, strong winds, extreme temperatures).
  • Please note that decisions are not made solely based on weather forecasts. Weather conditions can change quickly, and forecasted rain may pass before the scheduled session time. For this reason, the final decision to proceed or reschedule will be made on the day of the session.
  • The final determination rests with the photographer to ensure the best possible outcome for your session.


13. Gallery Delivery & Storage
  • Final galleries are available for a limited time. Clients are responsible for downloading and backing up their images.
  • Re-delivery of galleries after the gallery expiration may be subject to a fee.


14. Copyright & Usage
  • All images remain the property of Victorious Moments Photography.
  • Clients are granted a personal-use license and may not sell, alter, or use images for commercial purposes without written consent. Commercial use requires a separate agreement.


15. Model Release
  • By booking, clients grant permission for images to be used for portfolio, social media, and promotional purposes.
  • Requests for privacy must be submitted in writing prior to the session.


16. Communication

Email is the primary method of communication. Social media messages are not guaranteed to be monitored or responded to promptly.


17. Liability

Victorious Moments Photography is not liable for:

  • Technical issues
  • Weather-related disruptions
  • Client delays or lack of cooperation
  • Limitations caused by external conditions

The photographer is not responsible for compromised results due to uncooperative participants or environmental factors.


18. Force Majeure

Victorious Moments Photography shall not be held liable for failure to perform due to circumstances beyond control, including illness, emergencies, natural disasters, or government restrictions.
